    Terms and Conditions

    Last updated: 20 September 2026

    1. About us

This website is operated by GENIA Corp ("GENIA", "we", "us"). We provide AI-powered business automation services including lead generation, AI calling agents, email and SMS campaign automation, and CRM management. Contact: business@geniacorp.tech.

    2. Acceptance

By accessing this website, booking a demo, or subscribing to a service plan, you agree to these Terms. If you are contracting on behalf of a company, you confirm you are authorised to bind that company.

    3. Services and plans

Services are sold on a monthly subscription basis across our Starter, Growth and Pro tiers. The specific scope, deliverables and volumes for your tier are set out in your service agreement or order confirmation, which prevails over any general description on this website.

    4. Fees and payment

Fees are billed monthly in advance and are due on the invoice date unless otherwise agreed in writing. Prices are exclusive of VAT and any applicable taxes unless stated. We may revise pricing with 30 days' written notice, effective from your next billing cycle.

    5. Delivery policy

    • Our services are delivered digitally — there is no physical shipment.
    • Onboarding begins within 2 business days of payment confirmation, and setup (integrations, campaign configuration, agent training) is completed within 7 to 14 business days, depending on tier and complexity.
    • Once live, service runs continuously for the duration of the billing period, with reporting delivered monthly.
    • Custom software and automation builds are delivered according to the timeline in the applicable statement of work.
    • Delivery timelines assume you provide required access, credentials, data and approvals promptly. Delays caused by outstanding inputs extend the timeline accordingly.

    6. Cancellation policy

    • Monthly subscriptions may be cancelled at any time by giving 30 days' written notice to business@geniacorp.tech.
    • Your service remains active until the end of the notice period; no further invoices are raised after it ends.
    • Cancellation does not entitle you to a refund of fees already paid for the current period, except as set out in the Refund Policy below.
    • We may suspend or cancel a service for non-payment, misuse of the platform, or breach of these Terms, after giving you reasonable notice and an opportunity to remedy.
    • On cancellation, we provide an export of your campaign and contact data on request within 30 days, after which data may be deleted in line with our retention practices.

    7. Refund policy

    • Consumer right of cancellation: where the Electronic Communications and Transactions Act applies, consumers may cancel an electronic transaction within 7 days of the transaction and receive a refund, subject to that Act's exclusions.
    • Setup and onboarding fees are non-refundable once onboarding work has commenced, as these cover work already performed.
    • Subscription fees: if you cancel mid-cycle, the current month is not refunded, as capacity and campaign spend are committed in advance.
    • Service failure: if we materially fail to deliver the contracted service and cannot resolve it within 10 business days of you reporting it in writing, you may request a pro-rata refund for the affected period.
    • Custom builds are refundable only for work not yet commenced; completed milestones are non-refundable.
    • Approved refunds are paid to the original payment method within 10 business days of approval.

    8. Client responsibilities

You are responsible for the accuracy and lawfulness of any data you supply, for holding the necessary consents for contacts we engage on your behalf, and for complying with applicable marketing, telecommunications and data protection laws (including POPIA, GDPR, CAN-SPAM and TCPA where relevant).

    9. Intellectual property

We retain ownership of our platform, automation templates, scripts and underlying tooling. You retain ownership of your data, brand assets and content. You receive a non-exclusive licence to use deliverables for your own business purposes for the term of the agreement.

    10. Confidentiality and data protection

Each party will keep the other's confidential information private. We process personal data in accordance with our Privacy Policy and applicable data protection law.

    11. Limitation of liability

We do not guarantee specific lead volumes, conversion rates or revenue outcomes. To the maximum extent permitted by law, our total liability arising from the services is limited to the fees paid by you in the three months preceding the claim. We are not liable for indirect or consequential loss, including loss of profit or business opportunity.

    12. Third-party services

Our services rely on third-party platforms (telephony, email infrastructure, CRM and automation providers). We are not liable for outages, policy changes or account actions taken by those providers.

    13. Changes to these Terms

We may update these Terms from time to time. The version published on this page at the time of your transaction applies to that transaction.

    14. Governing law

These Terms are governed by the laws of the Republic of South Africa, and the parties submit to the jurisdiction of the South African courts.
